The terms and conditions of the services to be rendered by LegalBillAudit.com, a division of Legal Points, LLC, hereinafter referred to collectively as LBA, are as follows.
It is agreed that the legal bill(s) to be submitted for an evaluation must total at least $50,000, must be related to one matter, and must have been billed on an hourly fee basis. Upon acceptance for review, LBA will evaluate the submitted legal bill(s). Upon the conclusion of the evaluation, notification will be provided that will indicate if sufficient billing irregularities were present to the extent that would warrant the cost of a legal bill audit. (Note that questions about specific billing irregularities will not be addressed as part of the preliminary evaluation notification.)
Any service requested by the person submitting the legal bill(s) to LBA after receipt of the evaluation notification will be rendered on a project or hourly fee basis. However, it is agreed that no additional service for a fee will be provided unless agreed to and fully paid for in advance.
It is further agreed and represented by the person submitting the legal bill(s) to LBA for review and evaluation, that the person submitting the legal bill(s) is the person who is responsible for paying the submitted legal bill(s) and is authorized to submit the legal bill(s) to LBA for review and evaluation. The person submitting the legal bill(s) also represents that any legal bill submitted is genuine and is for actual legal services as described in the submitted legal bill(s).
It is understood and agreed that LBA retains the exclusive right to decline to review and evaluate any submitted legal bill. Where LBA declines to review or audit a legal bill, any pre-payment made for such service will be fully refunded to the person who made the pre-payment.
All legal bills may be reviewed and evaluated by a licensed attorney employed by LBA. However, it is understood and agreed that any evaluation provided does not constitute legal advice and that no attorney-client relationship is being formed.
The person submitting the legal bill(s) to LBA for review and evaluation agrees to waive any claim the person may have against LBA or any of its employees arising as a result of a review or evaluation or audit of a submitted legal bill. The person submitting the legal bill(s) to LBA for review and evaluation or audit also agrees to hold LBA harmless from any claims that may arise are a result of any dispute between the person and the attorney over any legal bills submitted to LBA for review and evaluation or audit.
Finally, it is agreed and understood that LBA will consider all material submitted for review as confidential and will not disclose the material submitted to another party without the permission of the person submitting the material or without a valid court order to do so.
